Ms. Somaiya, learned Counsel appears for the Applicant and submits that although the order directing disclosure has been served, however neither any disclosure has been made nor any payments have been received nor anyone represents the Respondents and therefore, this Court considering that the two Respondents are females issue notice under Order XXI Rule 41 of Code of Civil Procedure, 1908 directing their presence alongwith books or documents for oral examination as to whether any or what debts are owed to them and as Kanchan Dhuri 1/2

35-IA-1251-2025.doc to what other properties or means that the said Respondents have for satisfying the decree.

Having heard the learned Counsel and having considered her submissions, this Court is of the view that the Registry is directed to issue notice to the Respondents to remain present in Court on the next date, for oral examination under Order XXI Rule 41 of the CPC alongwith the necessary books and documents, with information as to what debts are owed to them and as to what other properties or means that the said Respondents have for satisfying the decree. 3.

List on 10th March 2026.
