The primary relief sought for in the captioned Interim Application is to recall / set aside an order dated 3 rd January 2020 passed in captioned Official Liquidator Report, in so far as it relates to the Applicant company. Heard Ms Shukla, Learned Counsel for the Applicant, who points out that this Court had vide a common order dated 3 rd January 2020 restored the status of 217 companies, who had sought voluntary winding up back to the
2/3 status of Active companies and directed the Official Liquidator to remove these companies from the register of companies in voluntary liquidation. She points out that the Applicant company's name was included in the common order on account of a miscommunication, despite the fact that the Applicant company had complied with all the requisitions for voluntary winding up. Mr. Sheth, Learned Counsel for the Official Liquidator has very fairly pointed out that the Official Liquidator has in the affidavit in reply in paragraph 6 stated that the Official Liquidator would have no objection if, the order dated 3 rd January 2020 is set aside to the extent of the Applicant company, subject to the Applicant company undertaking to file requisite documents with the office of the Official Liquidator. He submits that after the receipt of such documents, the Official Liquidator would scrutinize the same and if it is found that these documents are in order, the Official Liquidator will file a report under Section 497(6) of the Companies Act 2013 for dissolution of the Applicant company.
Having heard the learned counsel, and given the fact that there is today no objection to the interim application being allowed, subject to the Applicant company providing the requisite documents to the Official Liquidator, the Interim Application is allowed in terms of prayer clauses (a) and (b) which read thus:
"a. That this Hon'ble Court be pleased to recall and / or set aside the order dated 03/01/2020 passed in OLR/1/2020 in so far it relates to the Applicant Company listed under Exhibit I of OLR/1/2020, in the interest of justice.
b. This Hon'ble Court be further pleased to condone the delay, if any, in submission of documents to the Petitioner/Official Liquidator and
3/3 extend the same for a period of 6 weeks or such other period from the date of requisition by the Official Liquidator and be further pleased to direct the Petitioner/Official Liquidator to file its report under section 497(6) of the Companies Act 1956 for dissolution of the Applicant Company i.e., M/s. Pailton Engineering India Pvt. Ltd. (In Vol. Liqn.) before this Hon'ble Court;"
It is clarified that this order shall operate only qua the Applicant company.
