The Interim Application No.2352 of 2025 is mentioned, after the Board is discharged for the day, submitting that the Application is only for permitting substituted service.

Mr. Chapekar, learned Counsel, appears for the Applicant and seeks substituted service upon the Respondent No.1. Mr. Chapekar submits that earlier an attempt to serve the Respondent No.1 was not successful as the packet has been returned with the remark "addressee not present", although the same address is reflected on the MCA Kanchan Dhuri 1/2
55-IA-2685-2025.doc website. Mr. Chapekar submits that the Respondent No.2 has already been served. That it is only the Respondent No.1 who could not be served by ordinary means and therefore, this Application for substituted service by publication in Free Press Journal and Navshakti in the area of Navi Mumbai where the registered office of Respondent No.1 is situate be permitted.

Having heard the learned Counsel and having considered his submissions, and also having perused the Interim Application, the Interim Application is allowed in terms of prayer clause (a), which reads thus :
"(a) This Hon'ble Court be pleased to allow the Applicant to issue summons to the Respondent by way of paper publication in the English daily newspaper "Free Press Journal", vernacular (Marathi) daily newspaper "Navshakti"."

Let the publications be effected within a period of four weeks and an appropriate affidavit of service be filed in that regard. 5.
Interim Application is accordingly allowed and disposed as above.
