On the previous occasion, I have passed the following order:
1. Since counsel for the Society is not present today.
2. Stand over to 23rd January, 2026
3. It is made clear on the next date, the Court will not grant time on this ground.
Today, once again the Respondent society is not represented. I had also in the order dated 21 st November 2025 indicated my prima facie view that the conduct of the Respondent society was entirely high handed. The matter was Meera Jadhav
2/2 40-IA-2403-25.DOC placed today for further consideration since the Respondent Society is refusing to accept the Respondent No.1 as a member on the ground that the past dues/society charges in respect of Unit No.1106 have not been cleared. It is not in dispute that the said flat belong to the company in liquidation and was sold by the Applicant, who was a secured creditor of the said company in liquidation. The Applicant has also undertaken to this Court to make payment of all outstanding dues as and when the same are adjudicated upon by the Official Liquidator.
Furthermore, going forward, the Applicant has assured the Court that the flat purchaser shall duly discharged all society outgoings and/or charges and/or liabilities. Despite this the society is rigidly opposed admitting the Respondent No.1 as a member of the society. On the previous occasion the matter had parted since the learned counsel for the society was to take instructions. Since today, no instructions have been forthcoming and clearly the society stand firm in its view, th January 2026 High On Board and making I am standing the matter over to 30 it clear that on the next date the Chairman and Secretary of Respondent society shall personally present in Court.
