These matters have been listed under the caption "For Direction" today, in view of the administrative order passed by the Hon'ble The 1/4

Chief Justice on 29th November, 2025 assigning the two Suits to this Bench.

When the matters are called out, Mr. Samdani, learned Senior Counsel appearing for the Plaintiff in Suit No. 255 of 2025 at the outset submits that the Interim Application (L) No. 15368 of 2023 is wrongly on board.

Mr. Inamdar, learned Counsel appearing for the Plaintiff in Suit No. 58 of 2013 and for the Defendant No.1 in Suit No. 255 of 2025 agrees with the same.

Registry to remove the same from board.

Mr. Inamdar, learned Counsel appearing for the Plaintiff in Suit No. 58 of 2013 further submits that there is another Interim Application that has been filed for rejection of the Plaint in Suit No. 255 of 2025, which is not on board and which may also be listed on the next date.

Mr. Samdani, learned Senior Counsel appearing for the Plaintiff in Suit No. 255 of 2025 submits that no such application has been served or even appears to have been filed.

Let instructions be taken and circulation in respect of the said Interim Application also be taken for the next date when all these matters would be listed.

As regards the Interim Application (L) No. 28083 of 2025 in Suit No. 255 of 2025 is concerned, Mr. Samdani, learned Senior Counsel appearing on behalf of the Plaintiff in the said Suit seeks some time to file reply.

The Interim Application as can be seen is on lodging number. Let objections be removed and registered number be obtained within a period of two weeks, failing which the Interim Application to stand dismissed without further reference to the Court. 10.

Subject to the above, let reply be filed within a period of two weeks with copy to the other side. Rejoinder in two weeks thereafter with copy to the other side.
