On the previous occasion, the matter stood over today since the Certificate for destruction of goods in question was awaited. Learned counsel appearing on behalf of the Applicant has today tendered a Certificate dated 30/10/2025 which reads as follows :

"

CERTIFICATE To Whomsoever It May Concern This is to certify that 3460 Kg (517 Cases) of Damaged & Expired Goods from M/s, Evervital Lifesciences Pvt Ltd. ADDRESS, 3rd Floor, 4/110, Dawa Bazar, RNT Marg, Indore (M.P.) via Self, L.R. No., L.R. Date, Rst. No 7163 Vehicle No. MP09GH8516 on 09.10.2025 had been destructed by the company at its plant from 11/10/2025 to 12/10/2025 as per the guidelines." 2.

Hence, in light of this, nothing further survives for consideration in the interim application. The interim application is accordingly disposed of. 3.

The Court Receiver to stand discharged. The Court Receiver's Report No. 42 of 2023 in Interim Application (L) No. 37664 of 2022 in Commercial IP Suit (L) No. 37658 of 2022 stands disposed of.

The Applicant undertakes to make payment of all the necessary charges, expenses incurred by the Court Receiver. Learned counsel submits that the parties are attempting to amicably resolve their dispute and requests the matter be stood over under the caption for "For Settlement". 4.
