Heard Mr. Raheja, learned Advocate for Applicant and Mr. Daga, learned Advocate for Respondent No.1 in Interim Application and Petitioner No.2 in Testamentary Petition. 2.
Interim Application before me is for pendente lite under Section 247 of the Indian Succession Act, 1925. There are two Petitioners before. Deceased is the sister of both Petitioners. He has died without any issues. It is extremely unfortunate that the parties are not ad-idem and are fighting with each other.

Be that as it may, the limited proceedings before the Court is for appointment of an Administrator of the property, credits and estate of the deceased. Both the learned Advocates at the bar jointly informed the Court that deceased has left behind one flat and movable assets in the nature of Bank Account, mutual funds, shares and certain ornaments which are in the locker. Mr. Daga, learned Advocate informs the Court that apart from the aforesaid, there are further ornaments namely 20 tolas of gold which are with the other side. Be that as it may, the same will have to be placed appropriately on Affidavit with cogent reasons.

In the meanwhile, the flat is lying vacant. Appropriate Affidavit to be filed by Mr. Daga's client within a period of one week from today. Copy of the same shall be served on the other side. 5.
Rejoinder, if any, to be filed within one week thereafter. 6.
Stand over to 6th March, 2026. To be placed under the caption 'First on Board'.
