The Interim Application seeks restoration of captioned Commercial Arbitration Application, which is for the appointment of an Arbitrator. 2.

Heard learned counsel for the Applicant, he submits that the Respondents have been served with the present Interim Application and undertakes to file the Affidavit of service.

Having due regard to averments made in the Interim Application, in my view, the substantive interest of justice would best be served if the Arbitration Application is restored and the Applicants are given an opportunity to argue the same on merits. Thus, the Interim Application is allowed in terms of prayer clause 'a' which reads thus:

2/2 7-IA-2965-2025 (OS).DOC "a) That this Hon'ble Court may be pleased to exercise its powers under Section 11 of the Arbitration and Conciliation Act, 1996 and appoint a Sole Arbitrator that this Hon'ble Court deems fit and appropriate to enter reference as Sole Arbitrator to arbitrate upon the disputes, differences and claims raised by the Applicant against the Respondents, arising out of the Purchase Orders, dated 20.04.2022 and 22.04.2022." 4.

The office objections shall be complied with within a period of two weeks from today.
