Heard Mr. Mehta, learned Advocate for Petitioner. 3.

Since the non-consenting legal heir Mr. Anup Mohanlal Ramnani has not taken any steps as noted and recorded in objection No.5 of the requisition dated 01.04.2026, Department is directed to proceed with issuance of Grant to the Petitioner in accordance with law.

Mr. Mehta informs the Court that the non-consenting legal heir has not filed his Affidavit / Affidavit-of-service of citation despite the fact that he has been served the Citation. Once this is the position,

P13.IA.3054.2025.doc Petitioner shall file appropriate Affidavit-of-service in the Department which shall be accepted by the Department and for the purpose of issuing Grant steps will be taken.

In the Interim Application which has been filed by nonconsenting legal heir he has made a positive statement that he has been served with Citation.

In that view of the matter, dispensation of filing of Affidavitof-Service of serving Citation is allowed. 7.

Learned Advocate for Petitioner informs that all other objections have been complied with.

8.

If that is the position, Department is directed to proceed with issuance of Grant to the Petitioner in accordance with law. 9.

Praecipe is disposed.
