The learned Advocate for the Petitioner informs the Court that in view of the reasons mentioned in paragraph Nos.7 to 11 of the Interim Application, there was a delay due to which the office objections could not be removed. Resultantly, the Arbitration Petition came to be dismissed by the orders dated 26th August 2024 and 19th October 2024, in view of the Rule 986 of the Bombay High Court Original Side Rules, 1980.

I have perused both the orders. The reasons which are stated in the Application are prima facie credible and I have no doubt to disbelieve them. Exigency occurs with all litigants. In that view of the matter, the order dated 19th October 2024 and 26th August 2024 qua

22-IA-3078-2025.doc Commercial Arbitration Petition (L) No. 18227 of 2023 are quashed and set aside.

Resultantly, Commercial Arbitration Petition (L) No. 18227 of 2023 is restored back to the record and file of the Court. The learned Advocate informs the Court that all objections have been removed, except for filing the Power of Attorney. Be that as it may, whatever objections remain to be complied with shall be removed within a period of two weeks from today. Department shall allow the said objections to be removed as directed.

The Interim Application is allowed and disposed in the above terms.
