The delay of 164 days in taking out the present application is explained in paragraphs 5 and 8. Being satisfied with the reason given, the delay is condoned.

The plaintiff is directed to serve the Writ of Summons within four weeks from today. By this application, the plaintiff also seeks an amendment on account of change of the name of the plaintiff. The plaintiff has enclosed the certificate of change of name issued by the Ministry of Corporate Affairs.

Therefore, leave to amend the name of the plaintiff is granted. Amendment to be carried out within four weeks from today. Amended copy to be served on the defendants.

The Interim Application is allowed in terms of prayer clauses (a), (b) and (c).
