Learned Counsel for the Plaintiff has today invited my attention to the order dated 11 th February 2026 to point out that Respondent No.2 was given a period of two weeks time to file a disclosure affidavit setting out all properties, assets of the Respondent in terms of prayer clauses (d) & (f) of the interim application. For convenience, prayer clauses (d) and (f) are reproduced hereinbelow:

"(d) the Respondent No. 1 be required to disclose all their properties, assets and such properties be ordered to be attached due to the disobedience and breach of the said orders dated 19.01.2017, 09.02.2017, 28.02.2017 and 20.01.2021 passed by this Hon'ble Court;

(f) pending the hearing and final disposal of the present Interim Application, till such time the Respondent Nos. 1 and 3 show compliance of the said order dated 19.01.2017 passed by this Hon'ble Court in true letter Meera Jadhav

2/2 1-IA-3522-25.DOC and spirit, the Respondent Nos. 1 and 2 should not be heard in Commercial IPR Suit No. 386 of 2017 or any Interim Application filed therein," Learned Counsel today submits that Respondent No.2 has not complied with the said order nor is the Respondent No.2 present in court today. Given that this contempt petition is admitted vide an order dated 11 th November 2025 and given that since despite the fact that previously two non bailable warrants were issued which ultimately result in the presence of Respondent No.2 in court, despite which today Respondent No.2 is not present, hence issue a non bailable warrant to ensure the presence of Respondent No.2, returnable on 6 th April 2026.
