The Interim Application is taken out seeking the permission to amend the Commercial Execution Application. The proposed amendment is concerning subsequent events.

Dr. Tulzapurkar, learned Senior Counsel submits that the Respondents are not admitting the contents of the amendment. However, as per the settled legal position while dealing with Amendment Application merits are not required to be considered. The proposed amendment is concerning subsequent developments. 3.

Accordingly, the Interim Application is allowed in terms of Prayer Clause "A".

The amendment be carried out within a period of two weeks from today and amended copy to be served on the Respondents within said period.

Accordingly, the Interim Application is disposed of in above terms with no order as to costs.

Commercial Execution Application No.38 of 2017 be placed on board on 03rd December 2025.
