CORAM:

SUMAN SHYAM & MANJUSHA DESHPANDE, JJ.

DATED:

6TH OCTOBER 2025.

PC:- 1.

Heard Mr Pawar, learned counsel appearing for the Applicant. None has appeared for the Respondents despite due service of notice intimating that the matter would be posted before this Court today. An Affidavit in support of service of notice upon the Respondents has been tendered by the learned counsel for the Applicant/Petitioner. The same is taken on record and marked as "X" for the purpose of identification, with today's date.

2.

By filing this Application, the Applicant/Writ Petitioner is seeking interference with the order passed by the Registry on 18th February 2024, leading to the dismissal of the connected Writ Petition, due to failure on the part of the Applicant/Writ Petitioner to remove office objections within the time specified therein. 3.

The explanation for the failure to comply with the directions of the Registry has been furnished in paragraph 3 of the Application. We have perused the same.

4.

It appears that the Applicant is not to be blamed for the fault on the part of the counsel for failing to take necessary steps. Having regard to the nature of issue involved in the Writ Petition and the explanation furnished by the Applicant, we are, therefore, inclined to allow the Application.

5.

As such, the order dated 18th February 2024, in so far as the same pertains to the connected Writ Petition No. 12047 of 2021 is, hereby, set aside.

6.

The Applicant is granted two weeks time to remove the office objections.

7.

Subject to compliance of the same, the Writ Petition shall stands restored to its original file.

8.

Interim Application stands disposed of accordingly.

9.

Liberty to the Petitioner to mention the matter after removal of office objections.
