(1) I have brought the documents which were mentioned in the witness summons. I am producing the print-out of the signature form of the joint account of Ms. Leela Dhundiraj Rane and Mrs. Pramila Vijay Rane. The print-out of the signature form is from the original signature form which is uploaded on the Finacle system of the Bank. I have verified the print-out of the signature form from the signature form uploaded on the Finacle system of the Bank.
(2) I am also producing the Certificate issued under the Bankers' Book Evidence Act. The Certificate has been signed by me. I am also producing the account statement of the joint account for the period 24/05/2008 till 12/12/2020 in respect of the account of Leela Rane and Pramila Rane. I am also producing the statement of account for the period from 01/12/2020 to 02/05/2026 of Mrs. Leena Rane and Pramila Rane. I am also producing the Certificate under Section 2(8)(b) read 2/4
with 2A of the Bankers' Book Evidence Act. I am also producing the Certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023. (3) The print-out of the specimen signature form is marked as P-3/1. (4) The Certificate under the Bankers' Book Evidence Act is marked as PW-3/2. The statement of account for the period 01/12/2020 to 02/05/2026 is marked as PW-3/4.
Cross-examination of PW-3 by Mr. Nirman Sharma for the Defendant/ Respondent :
(5) I am 40 years of age. In 2014, I joined Dena Bank. I have personally not seen the deceased Leela Rane affix her signature on the signature form of the Bank. It is correct that I have not seen the deceased Pramila Rane affix her signature on the signature form of the Bank. It is correct to say that I have not scanned and uploaded on the Bank system the original specimen signature form. As per the usual practice, the original document is uploaded on the Bank's Finacle system, and I believe that the original specimen signature form, of which print-out has been brought today, was uploaded on the Bank's Finacle system. It is correct to say that I have not seen the original specimen signature form. It is correct to say that my testimony is based on the official records of the Bank and not on my personal knowledge. It is not correct to state that this is not the specimen signature.
