As per Affidavit of Service dated 10.07.2025, filed on 15.07.2025, defendant nos. 2 to 4 were served with Writ of Summons by R.P.A.D on 02.05.2025, 30.04.2025 and 03.05.2025, respectively. But, defendant nos. 2 and 3 failed to file written statement within stipulated period of 90 days. Hence, suit against defendant nos. 2 and 3 is transferred to the list of Undefended Suits.

Interim Application taken out by defendant no. 4 for condonation of delay in filing written statement is pending before the Hon'ble Court. Ld. Advocate for the plaintiff is seeking time to serve defendant no. 1 with Writ of Summons.

Time is granted to the plaintiff to take steps to serve defendant no. 1 with Writ of Summons and file affidavit of service till next date, failing suit against this defendant will be dismissed for non-compliance of O.S.Rule 87.

Office to issue fresh Writ of Summons, if required. The plaintiff to comply directions issued, vide Practice Note 60A.

Applicant/Defendant no. 4 to remove office objections of Interim Application (L) No. 23353/2025 and get the same registered and/or numbered within four weeks, failing office to list Application under caption 'Rejection'. Stand over to 15.09.2025.
