The present Interim Application has been preferred by the Applicant/Original Defendant Nos. 1 to 4 seeking condonation of 98 days' delay in filing their written statement, which has since been affirmed on 13th February 2025 and annexed at Exhibit B to the present Interim Application. 2.

Mr. Hingorani, learned Counsel who appears on behalf of the Plaintiffs opposes the present Interim Application. He states that the Interim

Application does not satisfactorily disclose the grounds which would entitle the Applicants for condonation of delay. He further submits that the documents that are referred to and relied upon in the present Interim Application are fabricated and that the Applicants cannot rely upon such documents in support of the present Interim Application. He therefore submits that there is no sufficient cause made out by the Applicants and therefore, the present Interim Application ought to be dismissed. 3.

I have considered the submissions made by both the parties and also gone through the record. The present Suit was instituted by the Plaintiffs some time on or about 12th February 2024. 4.

The present Suit seeks partition of the assets of Nirmal Singh Chandok and his wife Kuljit Kaur Chandok. The Plaintiffs and Defendants are the only legal heirs and representatives of their deceased parents and even according to the plaint, they are entitled to a portion/part of the estate and the assets left behind by their parents.

Given the nature of the partition suit, it is necessary to permit the Defendants to file their Written Statement on record and in such circumstances, I am satisfied with the reasons that are set out in the present Interim Application which seeks condonation of 98 days' delay in its filing.

Accordingly, the following order is passed :-

O R D E R

(i) Delay of 98 days in filing the Written Statement is hereby condoned and the Applicants are directed to file the Written Statement in the Registry on or before 19th January 2026 and serve a copy thereof on the Plaintiffs on or before the same date. (ii) The present Interim Application is accordingly disposed of. There shall be no order as to costs.
