The matter is on board today for directions. Mr. Kamod, Learned Counsel appearing on behalf of the Applicants has invited my attention to the order dated 23 rd July 2025, which records that Defendant No.1 had appeared on that date and had expressed his willingness to change the offending mark as well as the offending label and remove all offending Meera Jadhav
2/2 5-ia-4460-25.doc products from the E-commerce website on which they were listed. Mr. Kamod submits that if, Defendant No.1 is willing to abide by his statement, the whole controversy in the suit would stand resolved. Today, the court is informed that the product is continue to be advertised on various social media platforms. The application under Order 39 Rule 2A of the Civil Procedure Code has also filed by the Plaintiffs in this regard. Since Defendant No.2 is not present today, Mr. Kamod very fairly submits that the matter be stood over to two weeks from today. Hence, stand over to 3 rd September 2025.
Learned Counsel for the Plaintiffs shall serve a copy of this order on the Defendants. It is made clear that if on the next date none appeared for the Defendants, the Court shall proceed to hear the Interim Application and pass appropriate orders.
Ad-interim relief granted vide order dated 8 th May 2024 shall continue to operate till the adjourned date of hearing. [ARIF S. DOCTOR, J.] Meera Jadhav
