INTERIM APPLICATION NO. 4510 OF 2025 1.

By way of the present Interim Application the Applicant/Plaintiff has sought following emergency relief :

(a) That pending the hearing and final disposal of the suit the Court Receiver, High Court of Bombay, be ordered and directed with all powers under Order XL Rule 1 of CPC, to inspect and make a fresh inventory of the impugned goods bearing the mark TABLA TOD seized on 15 th July 2023 and stored at Purti Parab

2/2 27-IAL-16219-2023 @ Ors.doc Ankleshwar (GUJARAT) and submit a report to this Hon'ble Court on the status, condition and availability of the said goods. 2.

Learned Counsel for the Applicant/Plaintiff has further submitted that the Applicant/Plaintiff shall bear all the necessary costs, charges and expenses which are associated with the re-inspection which is sought for in the present Interim Application.

Learned Counsel appearing on behalf of the defendant very fairly submitted that he does not have any objection to the present Interim Application being allowed but has raised objection in the main Interim Application including, the jurisdiction of this Court. There is no objection to present Interim Application being allowed. The same is allowed in terms of prayer clause (a) subject to the Applicant/Plaintiff making payment of the necessary costs, charges and expenses.

Interim Application No. 4510 of 2025 stands disposed of. 5.

Interim Application (L) No. 16219 of 2023 stand over to 12 th November 2025.

Learned Counsel for the Defendant does not oppose the continuation of the Ad-interim relief granted earlier.
