Heard Mr. Jumani, learned Counsel for the Petitioner, Mr. Singh, learned Counsel for Respondent Nos.1 and 2 and Ms. Gholap, learned Counsel for Respondent No.3 (SBI).
2) The Look Out Notice issued to the Applicant/Petitioner, at the instance of Respondent No.3 (SBI), was assailed in Writ Petition No.2053 of 2022 which was disposed of by this Court by Order dated 23/04/2024 quashing the Look Out Notice. Being aggrieved by the said Order passed in the Writ Petition preferred by the Petitioner as well as in a batch of similar Writ Petitions, the Union of India has preferred Special Leave Petition (SLP) 1/3
which is pending disposal before the Hon'ble Supreme Court. 3) The Applicant seeks to travel abroad i.e., to Nepal during the period from 30/08/2025 to 19/09/2025, as indicated in the additional affidavit filed on 21/08/2025.
4) Mr. Jumani, learned Counsel for the Applicant submits that in view of the observations made in paragraph 2 of the Order dated 12/08/2024 passed by the Hon'ble Supreme Court, the Applicant is required to seek permission from this Court before travelling abroad. The learned Counsel for the Applicant has further submitted that on earlier occassions also, his client was permitted to travel abroad with the permission of this Court and he returned back to India as per the itinerary projected before this Court. As such, just like in the previous occassions, he would comply with any condition laid down by this Court, if permission is granted. 5) Responding to the above, Ms. Gholap, learned Counsel for Respondent No.3 (SBI) submits that she has strong objection to the prayer made by the Applicant in this Interim Application. 6) Mr. Singh, learned Counsel for Respondent Nos.1 and 2, however, submits that the Department will comply with any Order passed by this Court.
7) Having heard the submissions made by the learned Counsel for the parties and in view of the previous Orders passed by this Court on similar requests made by the Petitioner as well as the observation made in paragraph 2 of the Order dated 12/08/2024, we are inclined to allow the 2/3
prayer made in the Application.
8) The Applicant is, therefore, permitted to travel abroad i.e, to Nepal in between 30/08/2025 and 19/09/2025 (as per the projection made in the additional affidavit) so as to attend the programme of Isha Foundation. Upon his return back to India, the Applicant shall report to this Court by filing an Affidavit. In the said Affidavit, the Applicant shall also indicate the source of funding for the trip. The Affidavit shall be filed within 10 days from 19/09/2025.
9) With the above observations, the Interim Application stands disposed of.
10) Stand over to 30th September, 2025 under the caption 'for compliance'.
