DATED : 12th NOVEMBER, 2025 P.C. :- 1) During the course of hearing, since it is noticed by us that FIR No.RC-DAI-2021-A-2021 dated 08/06/2021 is registered against the Petitioner by CBI, ACB, New Delhi invoking Sections 120-B read with 420 of IPC and Sections 13(2) read with 13(1)(d) of the Prevention of Corruption Act, 1988 as based on the listing of the Applicant/Petitioner as willful defaulter, it would be appropriate that the CBI is heard before we grant permission to the Petitioner to travel abroad. Though the learned Counsel for the Petitioner has made an attempt to suggest to us that the permission is sought only in the wake of the Look Out Circular being issued by the Bank, in our opinion, if there is a FIR which is either under investigation or a charge-sheet pending for trial, it is 1/2
P.H. Jayani 23 IA4677.2025.doc necessary that we have the say of the CBI before we grant any permission to the Petitioner to travel abroad.
In such circumstances, learned Counsel for the Petitioner seek permission to add CBI, ACB, New Delhi as a party Respondent. 2) Let the necessary amendment be carried out within a period of one week from today and a notice of the Interim Application shall be served to the newly added Respondent through private mode of service. 3) List the Interim Application on 26/11/2025.
