Interim Application has been filed seeking condonation of delay of 87 days caused in filing Written Statement on behalf of Applicants who are original Defendant Nos. 1 to 3.

Learned counsel for Applicants submits that there was some time consumed in collating the documents, which were required for the purpose of drafting of Written Statement and therefore, there was delay of 87 days.

Learned counsel appearing for Respondent-original Plaintiff opposes the Application and submits that there is no sufficient cause demonstrated for delay.

Delay of 87 days which is within the prescribed limitation of 120 days is sufficiently explained in the Application. As such, delay of 87 days deserves to be condoned and is hereby, condoned. 5.
