Heard learned counsel for the parties.

There is a delay of 130 days in instituting this appeal. 3.
The explanation is to be found in paragraph 6 and 7 of the Interim Application.

Ms. Goyal assures this Court that at least hereafter, approval will be obtained expeditiously so that there is no delay in lodging of appeals.

The delay is not inordinate. The prejudice can be mitigated by imposing costs.

Though, Mr. Mistri strenuously opposed the application by pointing out that there are no good reasons for condonation and the circumstances set out in the application do not constitute sufficient cause, he was equally gracious in submitting that the costs may be given to charity.

Considering the totality of the circumstances and relying upon the assurance of the applicant that atleast hereafter matter would be attended to with greater diligence.

We condone the delay of 130 days, subject to payment of costs of Rs.25,000/- to be paid to High Court Employees Medical Welfare Fund at Mumbai within four weeks from today, the details of which are as follows:- Charitable Trust Bank Account Details :

Interim Application disposed of without any costs for order. 10.
If the costs are paid within time prescribed, this appeal is to be registered and placed for admission on 14 January 2026.

If the costs are not paid within the prescribed period, this Interim Application shall be deemed to have been dismissed without further reference to this Court.
