When the matter was called, Mr. Kapadia, Learned Senior Counsel appearing on behalf of the Plaintiff, at the outset, did not dispute the fact that the Applicant-bank has a charge on the property in question, however, submitted that the entire interim application could be amicably resolve. Learned Counsel for the Applicant-bank submitted that the Meera Jadhav
2/2 30-ia-5062-25.doc Applicant-bank today has buyers in respect of all the commercial shops bearing Nos.817. 818, 819, 821 and 822 situated at Parekh Market, Mama Parmanand Marg, Opera House, Mumbai. She submitted that the Applicant alongwith such buyers therefore, be permitted to inspect the said premises. Mr. Kapadia submits that there could be no objection to this course of action. Let inspection of the said premises be carried out after possession is handed to the agents of the Court Receiver. The Second Assistant to the Court Receiver, who is present in Court, submits that the inspection time shall be accordingly communicated to the parties.
Stand over to 18 th November 2025 for direction.
