It is pointed out by learned counsel for the Applicants that though by an order dated 2 nd December, 2025, both the Defendant No. 1-Society and the Plaintiff had sought time to file their respective Affidavit-in-Replies, it is only today in Court that an Affidavit-in-Reply has been served by the Plaintiff (Developer) to the Applicants. The Defendant No.1 -Society has yet not filed any Affidavit-in-Reply, thus the Affidavit-in-Reply of the Plaintiff is taken on record subject to payment of costs of Rs. 15,000/-.

In the event, the Defendant No.1-Society files any reply, the same shall be taken on record subject to payment of costs of Rs. 15,000/- to be paid to the Areeb This Order has been corrected pursuant to Speaking to Minutes of the Order dated 8 th January, 2026.
