1.

Interim Application No. 5237 of 2025 has been taken out by the Plaintiff seeking an order from this court declaring that the Writ of Summons has been duly served on Defendant No.1 (HUF) through its Karta, Defendant No.2 on or about 19th April 2025. Mr. Chirag Kamdar, learned Counsel who appears on behalf of Defendant No.2 states on instructions that Defendant No. 1 (HUF) does not exist and therefore, there is no question of his client, Defendant No.2 being its Karta. Without prejudice to this assertion, he waives service on behalf of Defendant No.1.

2.

With this clarification, no further orders are required to be passed in the present Interim Application. It is hereby disposed of with no order as to costs.
