When the matter was called Mr. Konwar, learned senior advocate appearing on behalf of the defendant submitted that the defendant has stopped using the mark supreme by which the mark supreme has more particularly set out at Exhibit - Q to the plaint.

In light of this, Mr. Bhagat submitted that further orders would not be required. Mr. Bhagat submitted that in view of this, the Leave Petition could be Kiran Kawre

2/2 SPEAKING37-IA(L)-17052-2025 (OS).DOC allowed and the prayer for passing off could also be allowed. There is no opposition to this course of conduct being adopted. Hence the Leave Petition is made absolute in terms of prayer clause (a) which reads thus: "a) That the Petitioner be granted Leave under Clause XIV of the Letters Patent of this Hon'ble Court to file the accompanying Plaint by way of a suit against the Respondent and combine the cause of action for passing off with the cause of action for infringement of its trade mark and copyrights and direct that the cause of action for passing off be tried alongwith the cause of action for infringement of trade marks in the same suit;" 3.

The Interim Application is also allowed in terms of prayer clauses (a), (b) & (c). In view of statement made by learned senior counsel. At this stage, learned senior counsel Mr. Konwar submitted that his client is willing to submit the disputes and differences to mediation.

Mr. Konwar submitted that at this stage, the same could be resolved between counsel and thus submitted that he would an attempting to resolve the disputes by sitting with Mr. Bhagat.

Stand over to 10 th November 2025 for filing consent terms.

Registry to accept affidavit in reply as also accept affidavit-in-rejoinder. (ARIF S. DOCTOR, J.) th October 2025.

This order is corrected as per speaking to the minutes of the order dated 9 Kiran Kawre
