After the matter was argued at some length, despite an initial objection, learned counsel appearing for the Respondents submitted that the Respondents are agreeable to the appointment of an Arbitrator subject however, to all the rights and contentions 1/2

Learned Arbitrator shall file his disclosure affidavit in compliance within a period of one week from the date on which a copy of this order is communicated. The Petition is accordingly disposed of.

Section 9 shall accordingly be converted to an Application under Section 17 of the Arbitration & Conciliation Act. The Arbitrator shall issue appropriate directions for complication of pleadings in the Section 17 Application. Interim order to continue till the learned Arbitrator so directs. (ARIF S.
