Interim Application No. 6390 of 2025 1.

Pursuant to order dated 6th March 2026 passed in Interim Application (L) No. 7350 of 2026 learned counsel for the plaintiff has tendered an affidavit dated 9th March 2026 on behalf of the plaintiff. Affidavit-cum-undertaking is in compliance and confirmation of the statement made on behalf of the plaintiff as recorded in order dated 6th March 2026. Affidavit dated 9th March 2026 is taken on record. The 2/4

undertaking in the affidavit is accepted as an undertaking to this court.

Learned counsel for the plaintiff submits that prayer clause (a) of this application is allowed on 18th September 2025. He further submits that in view of the relief granted on 6th March 2026 in Interim Application (L) No. 7350 of 2026 the plaintiff does not press for prayer clause (b), (c) and (d) in this application at this stage. He submits that the interim application can therefore be disposed of by keeping liberty to the plaintiff open to pray for further reliefs in the event of any further development.

Learned counsel for defendant nos. 1 to 3 submits that in view of the earlier orders this application can be disposed. 4.

In view of the aforesaid statement made on behalf of the plaintiff and the order dated 6th March 2026, the order dated 18th September 2025 granting relief in terms of prayer clause (a), shall continue till disposal of the suit. The plaintiff is permitted to withdraw prayer clause (b), (c) and (d), with liberty to seek such prayers, in the event of any further development. Rival contentions of the parties pertaining to the said prayers are kept open.

The interim application is disposed of in the aforesaid terms.

Commercial Suit No. 102 of 2025 6.

Learned counsel for defendant nos. 1 to 3 submits that he shall take steps to comply with the earlier statement made regarding filing written statement.

At the request of defendant nos. 1 to 3, stand over to 6th April 2026.

Ad-interim relief already granted earlier to continue till further orders.

Learned counsel for the plaintiff seeks time to file affidavit-in-reply to the application.
