The Plaintiff and Defendant have jointly insured a risk. It is the case of the Defendant that he has a re-insurance contract with proposed Defendant No. 2 and that such party is a necessary party. However, service is yet to be effected on the proposed new Defendant No. 2, and this has remained pending for four years. 2.
