Praecipe is moved by the Advocate for the Applicants for Speaking to the Minutes of the order dated 13th January 2026. Mr. Bedekar, learned Counsel appears on behalf of the Applicants whilst Mr. Pai, learned Counsel appears on behalf of the contesting Respondent no.1(c). Mr. Pai also consents to the modification that is sought in the praecipe. 2.

Accordingly, by consent the following order is passed :- (i) In paragraph 5(i), the words "CTS No. 100" shall stand replaced

with the words "CTS Nos. 100 and 102".

Necessary corrections be carried out and the corrected order be uploaded on the official website of this Court. 4.

Praecipe is disposed of accordingly.

By the said order dated 13th January 2026, the Court Receiver has been discharged without passing of accounts. 6.

Ms. Deshpande, 1st Assistant to the Court Receiver is present in Court today. She states that there is a credit balance of Rs.2,50,984.81 lying in the Suit account. She further states that an amount of Rs.1,01,824/- is to be recovered from the Applicants/Plaintiffs towards costs, charges and expenses of the Court Receiver. Both parties, who are present in Court today state that the Court Receiver shall deduct the said amount from the credit balance and thereafter, refund the remaining amount to the Applicants. This shall be done, on or before 30th April 2026.

Ms. Deshpande further states that there are unpaid BMC dues aggregating to Rs.32,06,406/-. To this, Mr. Bedekar, learned Counsel appearing for the Applicant states that the Applicants shall forthwith clear the outstanding dues as expeditiously as possible and no later than 15th May 2026 and submit proof thereof to the Court Receiver on or before the same date.
