Mr. Bhagat, learned counsel for the Defendant tenders the affidavit of the Defendant. The same is taken on record. The Defendant has tendered an unconditional apology to this Court and has annexed the revised label which is used by the Defendant. 2.

Prima facie perusal of the revised label would indicate that the Defendant's label is not deceptively similar to that of the Plaintiff's product. Learned counsel for the Plaintiff seeks time to take necessary instructions.
