Pursuant to the order passed by this Court, the proposed legal heirs are served. Learned Counsel appearing for the applicant submits that the proposed legal heirs are present and have no objection to being impleaded.

This is an application seeking post grant amendment to the succession certificate granted in resect of certain securities belonging to deceased Mehta Jayant Karsandas.

Learned Counsel appearing for the applicant submits that after the grant was issued on 22nd October, 2019, she discovered certain Amol Jadhav 1 of
54-ia-7226-2025 in tp-691-2019.doc physical shares belonging to the deceased which were not included in the schedule of assets filed along with the applicant's succession certificate. He would further submit that subsequent to the grant of probate, one of the legal heirs Bharti Rajesh Sanghvi expired on 13th September, 2020 and her legal heirs, are required to be brought on record and necessary amendment to that effect be also permitted. 4.
I have perused the schedule of assets and the schedule of amendment.

The notice was issued to the proposed legal heirs of Respondent No. 3 Rajesh Sanghvi who are present in Court today and have no objection to the post grant amendment. The amendment is necessitated by reason of discovery of shares in October 2024 subsequent to the grant of succession certificate. As one of the legal heirs has expired, the proposed legal heirs are also required to be brought on record.

Considering the nature of amendment there is no impediment in granting the same.
