This Interim Application has been filed seeking to delete the names of Defendant Nos.4, 5 and 10 who have passed away and to bring on record the legal heirs of Defendant Nos.4 and 10. The legal heirs of Defendant No.5 are already on record as Defendant Nos.2, 3 and 6. 2.

For the reasons stated in the Application, the same is allowed in terms of prayers (a) and (b) which read as under: Mohite 1/2

7 ia7396-25.doc "(a) Pass an order allowing the Applicant to carry out amendments in the present proceedings being Suit No. 1855 of 2007 in terms of the Schedule at Exhibit 'A'. (b) Abatement of the Suit, if any, be set aside." 3.

The amendment be carried out within a period of three weeks from today and amended copy of the Plaint be served on the Defendants. 4.

Re-verification is dispensed with.

Interim Application is disposed of.
