This matter was kept back in the morning session as the parties had agreed to dispose of the Interim Application on the basis of a draft Minutes of Order that had been worked out. 2.
When the matter is called out in the afternoon session at 3.30 p.m., Mr. Shah, learned Counsel, appears for the Judgment Creditor and submits that he has not got a chance to see the draft minutes of order.

Accordingly, this Court proceeds to pass an order of this Court based on the understanding which was arrived at in the morning session between Mr. Saraogi and Mr. Shah.

The Interim application is disposed of in the following terms : (i) That M/s. Shetgiri & Associates is appointed as Valuer in respect of Flat No. 201, situated at Ashok Palace CHSL, Makrani Pada Road, Malad East, Mumbai 400 097 and the parties shall equally bear the costs of the valuation. (ii) M/s. Shetgiri & Associates to furnish its valuation report within a period of four weeks.
(iii) After furnishing valuation report before this Court, the Sheriff of Mumbai within a period of two weeks to commence the process for auctioning the said property and place before this Court Sheriff's Report inter-alia for approval of the draft of the terms and conditions as well as the auction schedule.

The Interim Application accordingly stands disposed as above.
