On 12.12.2025, prayer clauses (a) to (c) in the Interim Application speaking post grant amendment was allowed. Only prayer clause (d) has remained. In the said order this Court has stated that after compliance of prayer clauses (a) to (c), grant of prayer clause (d) will be considered. Today the matter is listed at serial No.93. 4.

Mr. Rane would submit that compliance of prayer clauses (a) to (c) has been done by the Applicant. He would submit that there are two non consenting legal heirs who already have you should proclamation and citation including that of substituted service. 93A.IA.8101.2025.doc Appropriate affidavit of service has also been filed in respect of the actions taken by the Applicant. He would submit that there is no claim raised, no caveat filed till date by any of the two non consenting legal heirs.

In that view of matter he would persuade the Court for grant of prayer clause (d) so that the Applicant can submit the original Grant and get the rectified Grant. In view of the fact that Grant has been issued, no reason arises for this Court to pass any order in terms of prayer clause (d) whereby the Applicant once again seeks issuance of Letters of Administration in favour of Petitioner. The Interim Application is disposed.
