This Interim Application has been filed seeking condonation of delay of 1 day in filing the written statement. 2.
Ms.Isha Sawant, learned Counsel, appears for the Applicant and submits that earlier by order dated 9th December 2025, this Court had directed that written statement be filed by 17th December 2025, ARTI VILAS KHATATE however, by the time the written statement was sent for filing, it was by ARTI VILAS KHATATE Date:
2026.01.16 19:10:08 +0530 5.52 p.m., and that, therefore, there has been a delay of about 1 day in avk 1/3
filing the written statement beyond the period granted by this Court which ended on 17th December 2025.

Ms.Sawant explains that although the 30 days' period was counted from 17th November 2025, however, the order directing filing of written statement is of 9th December 2025 and that steps towards finalizing the written statement took some time. Although the written statement was notarized on 17th December 2025 itself, however, the scanning and other procedure for e-filing took time, and therefore, there has been a delay of 1 day which may be condoned and the Registry be directed to accept the written statement. 4.
Mr.Arnab Ghosh, learned Counsel, appearing for the Respondent/Plaintiff only raises a formal objection. 5.
Having heard the learned Counsel and having considered the submissions, for the reasons as above, this Court is of the view that sufficient cause for condoning the delay is made out. The delay of 1 day is hereby condoned and the Registry is directed to accept the written statement.
