Learned Advocate for the petitioner submits that the writ land is an ancestral property on which the petitioner has constructed a house and a grocery shop. An earlier attempt for demolition of the house property of the petitioner was made by issuing notice dated 2nd June 2021 by the Respondent No.3. However, the same could not be materialized. Now, by impugned notice dated 29th December 2025, the petitioner has been called upon to remove the encroachment alleged to

( 2 ) 902-WP-9-2026 have been constructed by the petitioner by 1st January 2026 or else the said encroachment would be removed for widening of the State Highway not by the Respondent No.3 but by the Respondent No.5-Nagar Panchayat Ashti, Tq. Ashti, Dist. Beed.
