Indisputably, the issue raised in the present petition is covered by the decision in Civil Writ Petition No.396 of 2021 passed by the Division Bench of this Court, (Coram: M. S. Karnik & Ajit B. Kadethankar, JJ.) vide judgment dated 23rd December, 2025. 3.
For the reasons recorded in the said judgment, the writ petition is allowed.

The impugned order dated 17th October, 2025 passed by Respondent No.2 - The Deputy Director of Education, Kolhapur is hereby quashed and set aside.

Respondent Nos.3 and 4 shall submit the pension papers of the Petitioner as full time Assistant Teacher at Respondent No.4 - Shikshan Maharshi Doctor Bapuji Salunkhe College, as per the old pension scheme i.e. Maharashtra Civil Services [Pension] Rules, 1982. 6.
Respondent No.2 shall process the pension proposal of the Petitioner as expeditiously as possible and within a period of eight weeks from the date of the receipt of the said proposal. 7.
