The grievance of the petitioner arises out of the task undertaken by respondent No.3 - a power transmission company at the behest of the State for laying down transmission lines in Taluka - Shirur, District - Pune.

According to the petitioner, even as per the document of the respondents themselves i.e. minutes of the meeting dated 29.02.2024 read with tabular chart annexed therewith dated 29.02.2024, the land belonging to the petitioner located at Gat No.1524, Village - Talegaon Dhamdhere, Taluka - Shirur, District - Pune is not covered under the aforesaid project of erecting towers and laying down transmission lines. It is submitted that despite the aforesaid fact, the respondents have taken certain steps, including attempts to carry out measurement in Gat No.1524, leading to an apprehension on the part of the petitioner that his MINAL SANDIP PARAB MINAL SANDIP PARAB Date: 2026.01.09 15:53:05 +0530 land is unauthorizedly sought to be dealt with for the project of laying 1/3
down the electricity transmission lines. It is submitted that, one day prior to filing of this petition, the respondents came to the spot along with police protection for carrying out measurement and when the petitioner relied upon the aforesaid document dated 29.02.2024, they still insisted upon carrying out measurement.

We have perused the minutes of the meeting dated 29.02.2024, pertaining to a meeting conducted by respondent No.2 - Sub-Divisional Officer with representative of respondent No.3 - Power Transmission Company, as also the Sub-Registrar of Taluka - Shirur, District - Pune, Deputy Superintendent of Land Records, Shirur and the Taluka Agriculture Officer of Shirur. In the minutes, a reference is made to the said project of laying down electricity transmission lines and a tabular chart annexed with the said minutes of meeting give the details of the land owners; the gat numbers (survey numbers); the area of land that would be required for erecting towers and laying down transmission lines; and the amount of compensation proposed to be paid to the land owners.

In the said tabular chart, there is no reference to Gat No.1524, wherein the land of the petitioner is located. Hence, we find that a strong prima facie case is made out by the petitioner in his favour. 6.
In view of the above, issue notice for final disposal, returnable on 20.02.2026, High on Board.

Mr. Patel, learned Additional Government Pleader waives notice on behalf of respondent Nos.1 and 2.

Additionally, the petitioner is permitted to serve respondent No.3 by way of private service and to file an affidavit of service before the next date of listing.

In the meanwhile and till the next date of listing, there shall be adinterim relief in terms of prayer clause (c), which reads as follows:- "c.
Pending the hearing and final disposal of the present writ petition, this Hon'ble Court may be pleased to restrain the Respondents from carrying out any activities in the subject land in relation to the said project / scheme either through themselves or through their agents, assignees, servants, staffs, employees etc. in any manner whatsoever;"

The petitioner is also permitted to file additional affidavit within two weeks from today.
