In this writ petition, the petitioner has raised grievance that the caste certificate issued in favour of the petitioner of belonging to 'Tadvi' scheduled tribe which is in old format, is not being accepted by the Caste Scrutiny Committee when the petitioner approached the caste scrutiny committee seeking validation of said caste certificate.

Though the petitioner has made multiple prayers seeking protection of his service, however, considering the nature of reliefs claimed, we are considering the prayer for issuance of caste certificate in Form 'C' in favour of the petitioner.

In the peculiar facts of the case, we direct respondent No.3 - the Sub-Divisional Officer, Parbhani, to issue a caste certificate to the petitioner of belonging to 'Tadvi' scheduled tribe in Form 'C' as prescribed under the Maharashtra Scheduled Castes, Scheduled Tribes, Denotified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance and Verification of) Caste Certificate Act, 2000, within a period of four (4) weeks from today, subject to the petitioner surrendering the earlier caste certificate.

The Sub-Divisional Officer may also verify the genuineness of the earlier caste certificate. With this direction the writ petition stands disposed of.
