It seems that the petitioner could not appear for the examination of Semester-III and Semester IV on account of her pregnancy and subsequent birth of a child. Further, it seems that the petitioner has even approached the Ombudsman, Student Grievance Redressal Cell, Shivaji University, Kolhapur. The said Ombudsman is somehow convinced with the application of the petitioner and requested the NCTE to allow the 1 of
relaxation to the petitioner so as to appear for the examination of Semester-III and Semester IV. Accordingly, the communication was also made by the office of the Ombudsman on 1st November 2025 to the NCTE.

Now the Petitioner submits that the authorities may be directed to permit the Petitioner to furnish examination forms for the Semester III and IV. He would submit the NCTE needs to be directed to issue appropriate relaxation order or directions.

Mr. Killedar, learned counsel for respondent No.1 would submit that the power to relax the time frame rests with the Chairperson of the National Council for Technical Education and the said authority is the only authority who can pass relaxation. He would submit the title clause of the Petition shows that the said necessary party is not arrayed as respondent to the Petition.

Mr. Narvankar, learned counsel for the respondent No.3 - University would submit that once the competent authority grants relaxation, his client would be in a position to process the further things. He fairly submits that the University has no reason to object the 2 of
Petitioner, but the University can not overstep the jurisdiction of the other authorities i.e. the National Council for Technical Education. 5.
In view of this, the petitioner to amend the title cause of the petition thereby making the Chairman, NCTE as party to the petition as also amend the prayer clause and produce copy of the order passed by the Ombudsman on record.

Learned counsel for the petitioner would submit that last date of filling the examination form falls on 23rd February 2026. In view of this, stand over to 20th February 2026 at 10.30 a.m. 7.
Mr. Killedar, learned counsel makes a fair statement to assist the Court that he would take appropriate instructions from proposed respondent No.6.
