Heard the learned Counsel for the parties.

The challenge in this petition is to an order issued by the District Collector (Excise), Thane, on 09th January, 2026, thereby directing the licensed establishments to close their SANTOSH SUBHASH KULKARNI Date: 2026.01.14 20:28:35 +0530 SANTOSH SUBHASH KULKARNI establishments on 15th January, 2026, being the polling day for the Municipal Corporation elections, and on 16th January, 2026 being the scheduled date for the counting of votes, till the declaration of election results, purportedly in exercise of the power under the Maharashtra Foreign Liquor (Sale on Cash, Register of Sales, Etc.) Rules, 1969, and the analogous Rules in relation to the country liquor and toddy.

The learned AGP, on instructions of the concerned Competent Officers (Pravin S. Tambe, Superintendent of Excise, Thane-I and Uttam Shinde, Superintendent of Excise, Thane-II) makes a statement that, on 16th January, 2026 after the counting of the votes is over and the results are declared, the respondents will allow the petitioners to open the licensed establishments and premises.

In view of the aforesaid statement on behalf of the respondents, the learned Counsel for the petitioners submits that, the grievance of the petitioners stands redressed. 5.
Recording the aforesaid statement made by the learned AGP, on the instructions of the above-named Competent Officers, the petition stands disposed.
