Heard.

2.

By this writ petition, the petitioner is seeking direction that the tribe claim submitted by the petitioner before the Scrutiny Committee be decided expeditiously. We find that the petitioner has been appointed on 30.07.2025 and in the appointment itself there is a clause directing the petitioner to submit the caste validity within a period of six (6) months, however, the petitioner did not bother to submit the caste claim and there is nothing to show that the petitioner has pursued the caste scrutiny committee. 3.

Be that as it may, we find that the tribe claim has been submitted on 26.11.2025 and immediately the petitioner has rushed to this Court seeking direction. In the meantime, the petitioner has received the notice issued by the employer directing the petitioner to submit the caste validity certificate in terms

2 937.WP.759.26.odt of clause of appointment order failing which the petitioner's service will be brought to an end.

4.

In a peculiar facts and circumstances, we direct the scrutiny committee to decide the tribe claim of the petitioner within a period of six (6) months from today. For only six (6) months the employer of the petitioner shall not take any coercive action against the petitioner for not submitting the caste validity certificate. We make it clear that the petitioner shall extend full cooperation for expeditious decision of his tribe claim and should file an undertaking before the employer of the petitioner stating that till the tribe claim of the petitioner is decided, the petitioner will not claim any service benefits such as promotion, confirmation, increment and pay fixation. 5.

The protection granted by this Court will be in operation only for a period of six (6) months from today. The petitioner shall not claim any equities. 6.

The writ petition is disposed of accordingly. (ABASAHEB D. SHINDE, J.) (SANDIPKUMAR C. MORE, J.) habeeb/
