CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.

DATED : 23 JANUARY 2026.

Per Court :

1.

At the outset, learned counsel for the petitioner seeks leave to correct the title clause of respondent No.2/Scrutiny Committee.

2.

Leave is granted. Amendment to be carried out forthwith.

3.

The petitioner is appointed from the Scheduled Tribe category on 14.07.2025 by respondent No.3, however, his appointment has been made subject to submission of validity certificate.

4.

Learned counsel for the petitioner submits that tribe claim of the petitioner has been submitted by the employer to

(2) 931 WP-903.2026.odt the respondent/Scrutiny Committee on 10.11.2025. However, in the meanwhile, employer of the petitioner issued showcause notice on 14.01.2026 calling upon the petitioner to submit tribe validity certificate, failing which the petitioner's service will be brought to an end. He, therefore, submits that the respondent/Scrutiny Committee be directed to decide the tribe claim of the petitioner expeditiously.

5.

Considering the fact that the petitioner is apprehending termination of the service, we direct respondent/Scrutiny Committee to decide the tribe claim of the petitioner within a period of six months from today. Till the tribe claim of the petitioner is decided, the employer of the petitioner shall not take any coercive action against the petitioner. 6.

We make it clear that protection granted by this Court will operate only till the tribe claim of the petitioner is decided and petitioner will not claim any equity.

7.

With these directions, petition stands disposed of. (ABASAHEB D. SHINDE) (SANDIPKUMAR C. MORE) JUDGE JUDGE VD_Dhirde
