The limited prayer that has been made on behalf of petitioner is that the appeal which has been filed by petitioner before the Hon'ble the Minister challenging the order under Section 39(3) of the Maharashtra Grampanchayat Act passed by Divisional Commissioner, Chhatrapati Sambhajinagar on 12.12.2025 to be decided within a stipulated period. Learned Advocate for petitioner submits that the term of petitioner would

WP_1038_2026 come to an end on 08.02.2026.

Learned AGP was directed to take instructions. Thereupon he is producing communication Exh. 'X' of today's date by Desk Officer, wherein it is stated that the appeal was preferred on 22.12.2025 and it was proposed to be heard on 06.01.2026, however, due to administrative reasons since the notices were not served the next date has been given. It is stated that the appeal would be decided within a period of eight weeks from today. We were concerned about the fact that the term of the petitioner is going to come to an end on 08.02.2026 and, therefore, we could have given an early date for the disposal of the appeal, but the fact is that the appeal itself is filed on 22.12.2025 and it appears that the other side is not yet served.

Under these circumstances, we dispose of the writ petition by directing that the Hon'ble Minister to expedite the hearing of appeal and get the notices served upon the other side and try to see that the appeal is disposed of before 06.02.2026.
