Heard Mr. Pawar, learned Counsel appearing for the Petitioner and Mr. Naik, learned AGP, for Respondent Nos.1 to 4 - State. 2.

By the present Writ Petition filed under Article 226 of the Constitution of India, the Petitioner is challenging the legality and validity of the Order dated 23rd January 2026, by which Revision Application No.97 of 2025 filed by the Petitioner against the Recovery Certificate, has been dismissed on the ground of non-payment of fifty percent of the amount as required under Section 154(2A) of the Maharashtra Co-Operative Societies Act, 1960. 3.

At the outset, Mr. Pawar, learned Counsel for the Petitioner, seeks leave to amend the name of Respondent No.6. Leave as sought is granted. Amendment be carried out forthwith. Reverification is dispensed with. Arjun 1 of

It is the submission of Mr. Pawar, learned Counsel for the Petitioner that the Petitioner is ready to deposit fifty percent amount and to show his bona fides he tenders a photocopy of a Demand Draft dated 9th March 2026 of Rs.64,72,062/- issued in favour of Sindhudurg District Central Co. Op. Bank Ltd. Branch Sawantwadi.

Issue notice to the Respondents, returnable on 23rd March 2026. 6.

Hamdast permitted.

In addition to the Court notice, the Petitioner to serve the Respondent Nos.5 and 6 and shall file affidavit of service before the returnable date.

In the meanwhile, the Petitioner to tender the Demand Draft issued in favour of the Sindhudurg District Central Co. Op. Bank Ltd., Branch Sawantwadi to Respondent No.5 - The Sindhudurg District Central Cooperative Bank Ltd.. The Respondent No.5 - Bank to accept and encash the said Demand Draft without prejudice to the rights and contentions. 9.

Stand over to 23rd March 2026 at 02:30 pm.

Till next date, no coercive steps be taken against the Petitioner. 11.
