Heard Mr. Khot, learned Counsel appearing for the Petitioner, Mr. Kalel, learned AGP for the Respondent-State and Ms. Shinde, learned Counsel appearing for Respondent Nos.3 and 4. 2.
The Petitioner has sought the following relief in the Writ Petition: "a) This Hon'ble Court be pleased to issue appropriate Writ, Direction, order in the nature of 226 of the Constitution of India and to direct the Respondent No. 3 to act upon their Letter/Order dated 23.11.2023 & 13.02.2023 and to remove the unauthorized construction made in Gat No. 295/1 at Malakapur, Tal. Karad, Dist. Satara within stipulated period which was constructed violating the provisions of Maharashtra Regional Town Planning Act 1966 & Maharashtra Municipal Councils, Nagar Panchayats and Industrial Township Act 1965;"

It is the submission of Mr. Khot, learned Counsel for the Petitioner, that Respondent No.3-Chief Oicer, Malakapur Municipal Council has issued notices dated 13th February 2023 and 23rd November 2023 for removal of unauthorized construction and no action has been taken till date.

Accordingly, the Writ Petition is disposed of by directing Respondent No.3-Chief Oicer, Malakapur Municipal Council to take appropriate action in accordance with law expeditiously, within a period of 6 months.

It is clariied that the contentions on merits of all the parties are expressly kept open.
