Heard Mr. Vijay Rajput, learned Counsel appearing for the Petitioners. He submits that reliefs in R.A.E. & R. Suit No.407 of 1998 and T.E. Suit No.139 of 2009 are the same. He submits that even the evidence will be also common in both these suit and therefore, it is necessary to club both these suits together. He submits that therefore, the Transfer Application No.276 of 2025 has been filed seeking these two matters pending before the two different Court be assigned to one Court. He submits that the said application has been rejected.

Mr. Rajput, learned Counsel appearing for the Petitioners submits that the Respondent Nos.1 and 2 are the only contesting Respondents who are the Plaintiffs in both these suits. 3.

Accordingly, issue notice to the Respondent Nos.1 and 2, returnable on 9th March 2026.

In addition to the Court notice, the Petitioners to serve the Respondents by private service and file affidavit of service before the returnable date.
