The writ petition essentially challenges an order passed by the Chief Judicial Magistrate in exercise of powers under Rule 107(11)(D-1)(vi) of the Maharashtra Cooperative Societies Rules, 1961.

This Court in the case of Amit Prakash Jori & Anr. vs. The State of Maharashtra & Ors., Writ Petition No.1331 of 2025 decided on 4 February 2025 has held that the exercise of such power is ministerial and is executionary in nature. Hence, the writ petition against such order need not be entertained. 3.

It shall be open for the petitioner to adopt appropriate proceedings as are available in law.
